goSmart Terms & Conditions
1. These Terms and Conditions (including our Policy on Privacy and Data Protection as well as our Terms of Use of our website) govern the collection and use of Points of the goSmart Cyprus Rewards Programme ("goSmart", “the Programme”) and set out the terms of the contract between LMS (Loyalty Management Services) Ltd (“us/we") and each Cardholder. A Cardholder can register with the Programme by applying for a Cardholder card (“goSmart Card”) and then be able to collect points on his/her purchases. If you apply to register with goSmart or use a goSmart Card or goSmart Payment Card you accept these Terms and Conditions. We may refuse an application if we believe there is a serious reason.
2. We will set up a goSmart Account to record Points collected or redeemed by each Primary Cardholder. A Primary Cardholder can allow other people (“Additional Cardholders”) to collect and redeem points on his/her goSmart Account. Additional Cardholders must register their personal details with us on a separate Registration Form which must also be signed by the Primary Cardholder.
3. Member registration is free. We may charge a small fee for additional services. Primary Cardholders must be over 18 (eighteen) years old. Additional Cardholders must be over 16 (sixteen) years old if they are on the Account of their parent or legal guardian and the relevant Primary Cardholder is responsible for them.
4. If a Primary Cardholder wants to change the Additional Cardholders on his/her goSmart Account he/she must notified us.
5. In the Programme participate companies (“Sponsors”) through whom you collect and redeem points. We credit points when one of our Sponsors tells us a Primary Cardholder or Additional Cardholder has undertaken a relevant transaction with them. A Primary Cardholder or an Additional Cardholder who was authorized by the Primary Cardholder, can redeem Points to obtain goods and services or discounts ("Rewards"). The Sponsors may change at any time. You can obtain an up-to-date list of Sponsors from us or through the Programme’s website.
6. The Sponsors determine the particular transactions on which Points can be collected and the number of Points to be collected per one 1 euro spent. There is a set number of Points needed to obtain a Reward for each Sponsor. The number of points collected per one (1) euro spent and the number of points needed for a reward value of one (1) euro or for a specific reward may change from time to time. Even though we can not control these changes, we will try to ensure that a selection of point offers will always be available for the duration of the Programme.
7. All Rewards are subject to availability. Point redemptions are made directly with the relevant Sponsor. We have no responsibility for the delivery, standard, quality or otherwise of any goods and services received or supplied or the failure of a Sponsor to honour a redemption or make a specific Reward available. These transactions and all Rewards are subject to all applicable legal rules and the terms and conditions (including booking requirements, cancellation restrictions, return conditions, warranties and limitations of liability) of the relevant Sponsor. When Points are redeemed we may act as intermediary between the relevant Cardholder and the Sponsor for the purpose of authorizing the transaction and to update the cardholder’s account.
8. Points cannot be redeemed until credited by us to a goSmart Account. Sponsors will take different periods to notify us of Points to be credited. We are not responsible for a failure, delay or error by a Sponsor notifying us of Points to be credited. We may also cancel Points if a Sponsor does not pay amounts owing to us or tells us to cancel Points (for example, because you returned or failed to pay for products or services for which the Points were issued).
9. Points have no expiry date but are lost if the relevant goSmart Account is closed or the goSmart programme ends. Points are also lost if an account shows no point activity (accumulation or redemption) for a continuous period of 36 months.
10. Redeemed Points cannot be used again. If a transaction on which Points are issued or redeemed is cancelled, reversed or not completed, we will reverse the associated Points movement when instructed by the relevant Sponsor. If insufficient Points are available, or we suspect fraud or misconduct, we may cancel or refuse redemptions and we may even close the relevant account.
11. A Primary Cardholder who collects points at regular intervals will be able to get an update of his/her Points balances and other Account information through the goSmart website, through his/her email or by calling the goSmart customer service center.
12. Points are personal to a goSmart Account and cannot normally be transferred. However, a Primary Cardholder with no Additional Cardholders can merge his/her points with those in another goSmart Account having the same address. Points can only be transferred from a goSmart Account to another goSmart Account on cases of death or divorce if adequate evidence is given to us.
13. Points can only be collected, held, transferred or redeemed as set out in these Terms and Conditions. Any other use, award, sale, exchange or transfer of Points, or attempt to do so, is a serious breach of these Terms & Conditions. Any Points not collected and held in accordance with these Terms & Conditions will be invalid and cannot be redeemed for Rewards. Any such Points on a goSmart Account will be deducted and, if they are redeemed, we will ask the Supplier to cancel the relevant Rewards and we may take other appropriate action. Points have no cash value.
14. Points may be collected for transactions using a goSmart Payment Card in accordance with the card issuer's terms. Points are collected for purchasers with any Sponsor if a Primary Cardholder or Additional Cardholdre presents his/her goSmart Card (or, for on-line or telephone transactions, the required information) before entering into a transaction on which such Sponsor offers Points. If a Primary Cardholder or Additional Cardholder uses a goSmat Payment Card with a Sponsor and wants to collect Points from that Sponsor as well as the card issuer, such a Primary Cardholder or Additional Cardholder will also need to present his/her goSmart Card.
15. Anyone issued with a goSmart Primary Card can redeem Points from his/her goSmart account. Additional Cardholders are not allowed to redeem points unless the Primary Cardholder authorizes them. The Primary Cardholder is responsible for any redemption by authorized Additional Cardholders and, in particular, for deciding whether anyone under 18 can redeem points. If a Primary Cardholder wants to cancel a redemption made by an Additional Cardholder, s/he should ask us as soon as possible and we will do this where we reasonably can. Security questions may be asked when a redemption is made. Rewards that must be sent by post will be sent to the latest address we have for the Primary Cardholder.
16. Our Policy on Privacy and Data Protection (which is part of these Terms & Conditions) sets out the information that we will collect on Primary Cardholders and Additional Cardholders, how a Primary Cardholder or Additional Cardholder uses his/her goSmart Card and collects and redeems Points, how this information will be used and who it may be shared with. We will comply with our Privacy Statement which every Primary Cardholder and Additional Cardholder should carefully read. If a Primary Cardholder and/or an Additional Cardholder notifies us that they do not wish to receive marketing information from us or be contacted by us and/or by Participating Companies for promotional purposes in connection with goSmart, we will comply with such request.
17. Our Terms of Use of our website (which is part of these Terms & Conditions) sets out the terms applty to all use of our website. Every Primary Cardholder and Additional Cardholder should carefully read these terms before using our website.
18. All goSmart Cards are our property and must be returned to us on request or destroyed when no longer valid for use. In such cases we may cancel a card or all cards on a goSmart Account. The Primary Cardholder is responsible for the security of all goSmart Cards issued on his/her Account and all goSmart Vouchers issued on that account. If a goSmart Card is lost or the holder thinks an unauthorized person has become aware of any security code, password or account number, they should contact the goSmart Customer Service Center immediately. All goSmart Vouchers should be treated like cash. We cannot be held responsible for any unauthorized use of Points or any lost or stolen goSmart Vouchers.
19. All goSmart Vouchers represent the value, in points or Cyprus Pounds, shown on their face. A goSmart Voucher can only be used to obtain goods and/or services from authorized goSmart Suppliers as set out in the goSmart website, by handing it over to the Supplier at the time of purchase. This may not be available within certain suppliers' participating retail outlets. Vouchers can be used as part payment and so if the price of the goods and/or services exceeds this value, the balance must also be paid on purchase. If the price of the goods and/or services is less than this value, no change will be given (unless the supplier states otherwise). When presenting your Voucher to a Supplier you must present your goSmart Card also. All goSmart Vouchers remain the property of the goSmart Programme and cannot be redeemed for cash nor sold or transferred for the value they represent.
20. We may close any goSmart Account on which no Points have been collected or redeemed for a continuous period of at least thirty-six (36) months. We may also, on notifying the Primary Cardholder, immediately suspend or terminate the rights of any Primary Cardholder or any Additional Cardholder, and/or close any relevant goSmart Account, if they breach these Terms & Conditions, if we reasonably believe that they have dealt with Points in a manner not permitted by these Terms and Conditions or any applicable Sponsor's or Supplier’s terms and conditions, if there is any theft from or misconduct in connection with us, any Sponsor or Supplier, if they supply false or misleading information to us or any Sponsor or Supplier. If we close a goSmart Account, all accrued points on that Account are cancelled. A Primary Cardholder can close his/her goSmart Account at any time by notifying us. If a goSmart Account is closed everyone’s rights to redeem Points from that Account are lost and all accrued points cancelled.
21. We reserve the right to change, limit, modify or cancel at any time any of these Terms & Conditions (including any regulations, benefits, conditions of participation, rewards and reward values) in whole or part, even if such changes may affect the value of points or rewards already accumulated. All goSmart cardholders will be bound by any such changes. Any such changes will be shown in these Terms & Conditions on the goSmart web site and will be effective immediately unless stated otherwise. A notice that a change has been made will be placed on the web site for a reasonable period of time. Any changes to any printed version of the Terms & Conditions will be contained in the next reprinting of that printed version. We will attempt to notify active members of major Programme changes, but will not be liable for failure to do so, and all members will nevertheless be bound by these changes. An active member is defined as any member having point activity (accrual or redemption) within the last 12 months.
22. We may suspend or terminate the goSmart Programme but will give 90 days notice before we do so. If this happens all goSmart Accounts will be suspended and/or terminated. If we sell or transfer or assign the goSmart Programme to another company we may transfer all of our rights and obligations under these Terms & Conditions without any further consent and may disclose or transfer all information we hold about Primary Cardholders and Additional Cardholders to a prospective or actual new owner. Such a disclosure or transfer will not alter the rights of such Primary Cardholders and Additional Cardholders in respect of the use that can be made of such information by such other company.
23. Our only responsibilities with respect to goSmart are set out in these Terms & Conditions which are subject to Cyprus law. We will only be liable to a Primary Cardholder who suffers loss as a result of our breach of these Terms & Conditions and, if so, our sole liability will be to credit to the relevant goSmart Account any Points which have been wrongly deducted or should have been credited but were not. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. We accept no liability for any loss suffered due to any act or omission of the Primary Cardholder, any Additional Cardholder any Sponsor or Supplier or Official Supporter.
